When all of the appeals are finished, Judge Hood will sign an order starting the "Effective Date." This officially opens the Settlement Facility-Dow Corning Trust and begins the first set of deadlines.  The second set of deadlines begin when you receive a letter from the Settlement Facility called the "Notification of Status."

90 DAYS

Deadline to file your "Notice of Intent" form with the bankruptcy court.

6 MONTHS

Deadline to file your "Participation Form" to opt in/out of the settlement.

2 YEARS

  
Deadline to  file your Rupture Claim.  You must have your Dow implant(s) removed unless you meet the Medically Contraindicated Exception.
 


Deadline to file your Silicone Gel Raw Material Claim (both Disease or Expedited Release) for those implanted from January 1, 1976 and before January 1, 1992 with one or more Silicone Gel-Filled breast implants made by Bristol, Baxter, Bioplasty, Cox-Uphoff (CUI),  Mentor, Koken, Medasil, Silimed, Societe Prometel, or Medacil Surgical.
 


Deadline to file other medical products claims (both Medical Condition and Expedited Release)
 

3 YEARS


For $2000.00 Expedited Release.   Exception: If you apply for disease and do not qualify, you will be offered an opportunity to select expedited release even after 3rd year.
 

10 YEARS

Deadline to file your Explantation Claim (For implant removals after 12-31-90)

15 YEARS

Deadline to file your Disease Claim and Increased Severity Claim (Limited $)

How long you will have from (NOS)

Deadlines from your receipt of "Notification of Status"

NONE SET

Time to provide Accceptable Proof of Manufacturer (POM)  for a Dow Corning implant (Class 5)

6 MONTHS

Deadline to cure "Deficiencies" in an Explant Claim.

6 MONTHS

Deadline to cure "Deficiencies" in a Rupture Claim.

12 MONTHS

Deadline to cure "Deficiencies" in a Disease Claim.
