IMPORTANT NOTICE: |
|
Due to upcoming deadlines under the Dow Corning Settlement,
July 26, 2004 is the last day that Hummer Law
Offices will be able to accept any new clients for either
breast implant settlement. If you have already
received a packet from our office, but not yet sent it back, we must receive
your completed packet by the close of business of July 26, 2004, otherwise we
will not be able to represent you.

 |
|
Our law firm represents women all across the United States who had at least one
breast implanted with either a silicone or saline implant
or tissue expander
before June 1st of 1993.
To date, our
law firm has discreetly represented over two thousand clients throughout the world-
just like you.
Many of our
clients have filed claims under the present MDL926 Revised Settlement Program (RSP),
formerly known as the "Global Settlement."
We also have hundreds of
other clients awaiting compensation who fall under a second settlement that is
set to begin on June 1st of 2004.
These are women who received Dow Corning
breast implants,
and other manufacturers who used
Raw Materials that were made by Dow .
As you may know, there are no lawsuits, hearings or depositions under these
implant settlements. Most importantly, claimants need not
prove causation (that their prosthesis is the
cause of their medical problems). Instead, claimants provide the Claims
Office with the necessary forms, medical reports and documents to support their
claim, whether it be for Explant, Rupture, Disease or Raw Material
benefits.
|
 |
|
As our client, you will be evaluated by experienced
board-certified doctors who will
diagnose whether you meet the Settlement criteria. The doctors send us
reports of their findings which diligently address all the exclusions so that
your claim is not found to be deficient. If you have qualifying symptoms, we
will submit your claim for the maximum recovery.
If for any reason, your claim is challenged, and you must now have one or more
of your symptoms re-confirmed by a doctor selected by the Claims Office (a
process known as "Quality Control" ). As your
attorney, we will fight hard
to see your case through. If necessary, will file the necessary
appeals to the Claims Administrator and former Judge Frank Andrews of the Courts
on your behalf. Over 500 of our clients have already received compensation.
Hundreds more are pending. Our law firm welcomes the
opportunity to assist you!

If you are thinking about having breast surgery to have your breasts enlarged, we urge you to make an educated
decision by researching the subject first. In addition to what your
friends, spouse or doctor has to say, form your own opinions. You will find that
there is no shortage of controversial information on this procedure on the
internet. Please take a good look, and form your
own opinion.

All Claimants attempting to file a claim on their own have our permission
to use any of the resources on this web site freely for their personal use.
We hope that this free information will help you in filing a successful claim.
Much of the material is reprinted from other sources
for your convenience.*
However, experience has shown that it takes specialized knowledge to
successfully file these types of claims, which are best handled by a
qualified lawyer.
However, we fully understand if you would like to
represent yourself. In all honestly, we would like to see every woman who
has been injured to receive the compensation that they deserve, whether
they choose for us to represent them or not.
Best Wishes,
Robert P. Hummer, Jr. and Staff

Dow Effective
Date Set For June 1, 2004!
|
|
The Settlement Facility for Dow Corning Trust (SFDCT) is in
full operation and looking over claims that are being sent in to them. However,
no claims will be paid until after the Dow Settlement officially starts on
June 1st of 2004.
At this time, Hummer Law Offices is busy processing and submitting claim forms,
along with all pertinent supporting documentation, to the SFDCT. Forms
being sent in include Proof of Manufacturer, Explant, Rupture, Disease and
Notice of Intent forms, along with all pertinent medical
documentation. As you may know, the SFDCT cannot review your claim for
benefits until you first have
"Acceptable Proof" of your manufacturer. Prior to the
"Effective Date" of June 1st, 2004, SFDCT will send you a Proof of
Manufacturer Notification of Status letter that lets you know the results of
your Proof of Manufacturer review.
|
 |
|
|
 |
|
 |
|
On June 1st, 2004 "New Claimants" will only have
89 days
in which to register with the SFDCT by filing a "Notice of Intent" form. After
this deadline, no new claimants will be allowed in the Dow
Settlement. In short, we highly recommend that you register today,
unless you have already done so.

meet the medical criteria.
If you have never registered for benefits under the RSP, it is
not too late to do so.
If you register today, you will be considered a "Late" Claimant. To receive
compensation, you will need to meet the medical criteria for one of the
following:
If you are
considered a "Current" claimant (means that you filed with the RSP before
December 16, 1996) or your claim status is considered "Other",
additional benefits may be available to you such as $3,060.00 for Explant,
or a $1,020.00 for Advance payment.
